Terms and Conditions
Parties
These terms are applicable to The Eclectic Petroleum Collection (referred to herein as “the
Collection”, “we”, “us”, or “our”) and the Member (referred to herein as “Member”, “you”, or
“your”) under the Vehicle Membership Agreement.
1. Definitions & Interpretation
1.1 “Membership” means the membership tier you select (Silver / Gold / Black) entitling you to
certain storage and/or care services under this Agreement
1.2 “Vehicle” means the motor vehicle(s) you enrol under the Membership for storage / care /
services
1.3 “Indoor Storage Facility” means the storage location used by the Collection for inside vehicle
storage
1.4 “the Premises” means the land surrounding the Indoor Storage Facility
1.5 “Services” means the storage and any ancillary services (collection/delivery, maintenance,
detailing, battery care, repositioning, etc.) provided to you under your Membership or separately
stipulated
1.6 “Force Majeure” means an event beyond the reasonable control of a party (e.g. flood, fire,
storm, riot, war, act of government, etc.)
1.7 References to “you”, “your” include your agents, employees, drivers, and any persons acting
on your behalf
2. Membership Levels & Services
2.1 You may select one of the following levels (or others if offered and covered on our website):
2.11 Silver Membership: secure vehicle storage, indoor, 24/7 CCTV, ANPR controlled
entrance, discrete premises, dedicated contact number, full insurance, 48-hour collection
notice, pickup appointment slot of 0.5 hours.
2.12 Gold Membership: secure vehicle storage, initial (30%) discounted collection, car
cover, NOCO battery maintenance and conditioning, 24/7 CCTV, secure vehicle storage,
ANPR controlled entrance, manned discreet premises, dedicated contact number, fully
insured service, 24hr collection notice, pick up appointment slot of 0.5 hours.
2.13 Black Membership: free initial collection within 50 miles, car cover, tire cushions,
NOCO battery conditioning including health check, initial bespoke detail & monthly
maintenance clean, M.O.T handling, 24/7 CCTV secure vehicle storage, ANPR controlled
entrance, manned discreet premises, 24 hour collection notice, dedicated contact number,
fully insured service, pick up appointment slot of 0.5 hours.
2.2 Services beyond the standard inclusions will be charged separately at agreed rates in writing or
covered on the Collection’s website.
INTERNAL
2.3 The Collection reserves the right to delay or refuse collection and/or
delivery of your vehicle if the Collection trailer is otherwise occupied for a
commercial purpose.
3. Payment Terms, Renewal & Termination
3.1 The Member shall pay the agreed Membership fees (as set out in clause 4)
in advance for each monthly period of storage.
3.2 Payment shall be made by direct debit on the monthly anniversary of the Membership start date.
3.3 Membership and storage rights will not commence or continue until payment for the relevant
period is received.
3.4 The Member may terminate their membership by providing no less than 30 days' written notice
to the Collection.
3.5 No refunds or pro-rata adjustments shall be made for any unused portion of a paid monthly
period.
3.6 Should payment not be received for any monthly period, the Collection reserves the right to
remove the vehicle from indoor storage and store it in an external storage location for up to one
calendar month while attempting to contact the Member.
3.7 If, after one calendar month from the missed payment date, payment remains outstanding and
no arrangement had been made, the vehicle will be deemed abandoned.
3.8 In such circumstances, the Collection shall be entitled to report the vehicle as abandoned to the
local police force and cooperate fully with the authorities in accordance with the applicable UK
law.
3.9 The Collection accepts no liability for any loss, damage or costs incurred as a result of such
vehicle abandonment.
4. Membership Fees
4.1 Membership fees for each level are set out below:
4.11 Silver membership fee is £150 (car) or £65 (motorcycle)
4.12 Gold membership fee is £199 (car) or £99 (motorcycle)
4.13 Black membership fee is £299 (car) or £149 (motorcycle)
5. Vehicle Delivery, Acceptance & Condition
5.1 the Vehicle will be fully inspected at the point of collection or delivery, the inspection will be
recorded by way of the Vehicle Check in Form, accompanied by images that act as proof of the
condition and status of the Vehicle at the commencement of the Membership.
5.2 The Vehicle Check in Record will be signed by both the Collection and the Member.
INTERNAL
5.3 If any changes are required to the Vehicle Check in Form, the Member must
notify at the time of the check in. Any subsequent changes cannot be accepted.
6. Access & Use of Facility
6.1 No Members are permitted to drive into the Indoor Storage Facility,
vehicles should be parked in the Premises, and the Vehicle will be moved by
the Eclectic Petroleum team.
6.2 Access to the Premises will be available between 8am and 8pm every weekday and between
10am and 3pm on Saturday and Sunday, during a pre-arranged 0.5-hour slot (arranged with the
relevant 48- or 24-hour notice).
7. Insurance, Risk & Liability
7.1 The Collection holds public liability insurance for £5,000,000 and a total stored/transported
vehicle insurance to the value of £500,000.
7.2 The Collection will not claim damage caused by a Member to their own Vehicle and Members
are expected to cover any damage caused to other Member’s vehicles.
8. Additional Services, Repairs & Third-Party Work
8.1 Any additional work (detailing, cleaning, servicing, MOT, transport, etc.) must be agreed in
writing in advance. Costs may include a handling fee.
8.2 There is no guarantee or warranty offered by the Collection on third-party work completed.
9. Member Duties & Representations
9.1 Member duties include maintaining accurate ownership / contact details, and up to date
payments.
10. Confidentiality, Privacy & Discretion
10.1 The Collection shall maintain discretion about members and their vehicles.
10.2 The use of CCTV is for security and record keeping purposes only.
10.3 Both the Collection and the Member shall comply at all times with all applicable data
protection laws and regulations, including the General Data Protection Regulation (UK GDPR) and
the Data Protection Act 2018.
10.4 The Collection will collect, store and process personal data only as necessary for the
performance of this Agreement, to maintain customer records, and to comply with legal
requirements.
10.5 All personal data is processed lawfully, fairly, transparently and will not be retained for longer
than is necessary.
10.6 The Collection shall take all reasonable technical and organisational measures to ensure that
any personal data in its possession is protected and secure against unauthorised processing,
accidental loss, destruction, or damage.
INTERNAL
10.7 Personal data will not be shared with any third parties unless required by
law, or where necessary to fulfil the Collections contractual obligations.
10.8 Members have the right to request access to, correction of, or deletion of
their personal data held by the Collection, as well as the right to restrict or
object to its processing.
10.9 Any such requests should be made in writing to the Collection.
11. Force Majeure & Events Beyond Control
11.1 Neither party is liable for non-performance caused by force majeure events.
13. Amendments & Variation
13.1 Any changes to this Agreement must be notified to you in writing 7 days before the
change/changes come into effect.
14. Entire Agreement & Severability
14.1 This Agreement supersedes all previous agreements. Invalid provisions do not affect
enforceability of the rest.
15. Governing Law & Dispute Resolution
15.1 This Agreement is governed by the laws of England & Wales. Disputes fall under exclusive
jurisdiction of the courts of England & Wales.
